Acceptance and Agreement

When you create an account, upload financial data, or use any feature of our platform, you're entering into a binding agreement with kinarevix. If you're acting on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these terms.

We update these terms occasionally to reflect changes in our services or legal requirements. Material changes will be communicated through email or a notice on our platform at least 30 days before they take effect. Continuing to use our services after changes become effective means you accept the revised terms.

Service Description and Limitations

kinarevix provides financial forecasting tools, budgeting software, and analytical services designed to help Australian businesses make informed financial decisions. Our platform processes your financial data to generate projections, identify trends, and provide planning insights.

Your Responsibilities and Account Security

You're responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Choose a strong password and don't share it with anyone—yes, even trusted employees should have their own accounts.

Data Ownership and Usage Rights

You retain all ownership rights to the financial data you upload to our platform. We don't claim ownership of your business information, forecasts, or reports. However, you grant us permission to use your data to provide the services you've signed up for.

This means we can process, analyse, and store your data as necessary to generate forecasts, create reports, and maintain service functionality. We may also use anonymised, aggregated data for improving our services, developing new features, or conducting industry research. Your specific business information won't be identifiable in any aggregated data we use.

Privacy and Data Protection

We take your privacy seriously and handle your financial data in accordance with Australian Privacy Principles under the Privacy Act 1988. Our data practices are detailed in our Privacy Policy, which you should read alongside these terms.

We implement industry-standard security measures to protect your data, including encryption during transmission and at rest, regular security audits, and access controls. However, no system is completely secure, and we can't guarantee absolute security of data transmitted over the internet.

Payment Terms and Subscriptions

Access to kinarevix's services requires a paid subscription. Prices are listed in Australian dollars and include GST where applicable. Payment is processed through secure third-party payment processors, and we don't store your complete credit card details on our servers.

Service Availability and Modifications

We strive to keep kinarevix available 24/7, but occasionally we need to perform maintenance or updates. We'll notify you in advance of scheduled downtime when possible. Sometimes technical issues happen unexpectedly, and we'll work to resolve them as quickly as we can.

We regularly update and improve our services, which means features may change over time. We might add new functionality, modify existing features, or occasionally discontinue features that aren't working well. We'll communicate significant changes that affect how you use the service.

Limitation of Liability

kinarevix provides financial planning tools, not financial guarantees. Our forecasts and projections are based on the data and assumptions you provide, combined with our analytical models. Actual financial outcomes will differ from projections—that's the nature of business planning.

We're not liable for business decisions you make based on information from our platform, losses resulting from inaccurate data you've provided, or outcomes that differ from your forecasts. To the maximum extent permitted by Australian law, our total liability to you for any claims arising from your use of our services is limited to the amount you've paid us in the twelve months preceding the claim.

Intellectual Property Rights

The kinarevix platform, including its software, design, functionality, and content, is protected by copyright, trademark, and other intellectual property laws. We own or license all rights to the service itself—you're granted a limited, non-exclusive licence to use it according to these terms.

You can't copy, modify, distribute, or create derivative works from our platform. Any feedback or suggestions you provide about our services may be used by us without obligation to compensate you.

Third-Party Services and Integrations

Our platform may integrate with third-party accounting software, banking services, or other business tools. These integrations are provided for your convenience, but we don't control or take responsibility for third-party services. Your use of integrated services is subject to their own terms and conditions.

We're not responsible if third-party services change their APIs, discontinue features, or experience outages that affect functionality within kinarevix. If you encounter issues with integrations, we'll do our best to help, but some problems may need to be resolved with the third-party provider.

Termination

Either party can terminate this agreement at any time. You can close your account through your account settings or by contacting us. We may suspend or terminate your access if you breach these terms, use the service for prohibited purposes, or if your account remains inactive for an extended period.

Upon termination, you'll lose access to the platform and your data. We'll retain your data for a reasonable period (typically 90 days) to allow you to export it, after which it may be permanently deleted. You remain responsible for any outstanding payments owed at the time of termination.

Governing Law and Disputes

These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of New South Wales.

Before initiating legal proceedings, we encourage you to contact us directly to try to resolve any issues. Most problems can be sorted out through straightforward communication, and we're committed to working with you to find reasonable solutions.

General Provisions

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right or provision doesn't constitute a waiver of that right. These terms, together with our Privacy Policy, constitute the entire agreement between you and kinarevix regarding your use of our services.

We may assign our rights and obligations under these terms to another entity, for example in connection with a merger or acquisition. You may not assign your rights without our prior written consent.
